CSG WAIVER

A condition of acquiring SpinTel Phone plan/bundle is that you agree to waive the rights and protections afforded under the Telecommunications (Customer Service Guarantee) Standard (the "CSG") which only applies to the Telephone component of the SpinTel Phone plan/bundle. If you do not wish to waive these rights, please select a SpinTel Phone plan which does not require a waiver of the CSG.

The Customer Service Guarantee (CSG) is a guarantee that is prescribed under the Telecommunications Act 1997 whereby consumers have certain rights in the connection of a standard telephone service. These rights include:

1. The obligation to be provided with information pertaining to the CSG and applicable performance standards.

2. The right to receive compensation if a standard telephone service is not connected within a prescribed timeframe;

3. The right to receive compensation if remedial action to repair a fault on a telephone service is not achieved within a legally binding timeframe;

4. The right to receive compensation if SpinTel were to miss an appointment with a customer with whom SpinTel had originally made the appointment for the connection of a telephone service.

The specified timeframes and the amounts of compensation will vary and are dependent on customer location, infrastructure available at the customer premises and the actual length time that the fault has been present. As an example, the range of compensation for an unprepared telephone fault varies from $14.52 to $48.40 per day, whereas a missed technician appointment ranges from $14.52 to $24.20. SpinTel Phone/bundle plans are supplied on the basis that you have waived the CSG on the Telephone component only. SpinTel plans are cost optimised to represent the best value for money. However, as an individual, you have the right to evaluate SpinTel's plans to determine if the savings are justifiable in waiving the rights given under the CSG.

By agreeing to this document you are waiving your rights and protections under the CSG and are not able to make a claim against SpinTel for compensation under the CSG in connection with the SpinTel Phone service that you have acquired.

For the avoidance of doubt, your acceptance of this proposed waiver of your rights & protections relating to CSG will be effective on the date you agreed to this waiver (either by applying online by ticking "I agree" or agreeing orally if you had applied on the phone).

If for any reason within five days you decide to withdraw your CSG waiver (where applicable), and communicate the withdrawal to SpinTel (either written or oral), then SpinTel may terminate the agreement for the supply of the SpinTel Phone/bundle Service to you.
